5, was sentenced today to 50 years in the state penitentiary in connection with a 2012 aggravated assault.On August 19, 2012, a 44 year-old Port Arthur woman (who was sometimes living with Tate) began a three day episode of being repeatedly assaulted and forced to engage in sexual intercourse. She was forced to remain in a small garage apartment, but managed to convince Tate to let her go by promising that she would give him all of her pain medications if he would just take her to the hospital. Emergency room personnel were familiar with the woman, and it was they that notified the Port Arthur Police Department.
A Criminal District Court jury heard testimony over two days before returning a guilty verdict after only 45 minutes of deliberation on February 26, 2013. Punishment evidence included one felony prior for aggravated assault in 1996, and also the fact that Tate was on bond for a pending felony theft on the day that he committed the 2012 aggravated assault. Tate must serve twenty-five (25) years of his sentence before he can be considered for parole.
Prosecutor Rachel Grove said, "This was a predator savagely attacking a woman who was already injured. She suffered at his hands for three painful days, and he treated her like she was something less than human. He deserves every day of the fifty years that the jury gave him".
The felony theft case is still pending before the Criminal District Court, Judge John Stevens presiding.
