Judge hears challenge of Texas' gay marriage ban

AUSTIN, Texas (AP) -- Attorneys for two same-sex couples have faced off with the Texas attorney general's office over whether a federal judge should lift the state ban on gay marriage.

District Judge Orlando Garcia said Wednesday he would issue a decision later. He says he fully expects the U.S. Supreme Court to have the final say.

Two Texas men have filed a civil rights lawsuit seeking permission to marry, while a lesbian couple married in Massachusetts has sued to have their marriage recognized.

An attorney for the state said it should be a question for politicians to decide.

Seventeen states recognize gay marriage and similar lawsuits are underway in 22 other states.
